These Terms of Service (hereinafter “Terms”) govern the use of the website www.medicalnavigator.com (hereinafter “Website”) and the services offered by K.B. Innovation Group s.r.o., a limited liability company incorporated under the laws of the Slovak Republic, with its registered office at Staré Grunty 204/16, 841 04, Bratislava, Slovakia, Company Registration Number (IČO): 56258119, Tax Identification Number (DIČ): 2122256906 (hereinafter “Medical Navigator”, “Company”, “We”, “Us” or “Our”).

By accessing or using the Website or any services provided by Medical Navigator, the user (hereinafter “User”, “You” or “Your”) hereby acknowledges that they have read, understood, and agree to be bound by these Terms in their entirety, together with the privacy policy, available at: www.medicalnavigator.com/privacy-policy/ (hereinafter “Privacy Policy”). If You do not agree to these Terms, You must immediately cease use of the Website and Services.

1 Scope of Services

1.1 The Company provides the following services (hereinafter “Core Services”):

  1. access to an information platform containing data regarding hospitals, medical centers and healthcare facilities (hereinafter collectively “Clinics”) listed on the Website;

  2. provision of general information enabling the User to independently compare Clinics;

  3. consultation with a dedicated representative of the Company (hereinafter “Coordinator”), including personalized recommendations based on the User’s specific requirements, preferences and circumstances;

  4. facilitation of contact between the User and the User’s selected Clinic and support in communication with the Clinic;

  5. assistance with appointment scheduling, coordination, and ongoing organizational support from initial consultation through completion of the User’s treatment at the selected Clinic.

1.2 Subject to separate agreement and payment of applicable fees, the Company may provide the following optional services (hereinafter “Additional Services”): 

  1. visa support and documentation assistance;

  2. arrangement of airport transfers and local transportation;

  3. assistance with accommodation booking;

  4. assistance with insurance claims and reimbursement processes.

The scope, pricing, and specific terms applicable to Additional Services shall be set forth in an individual quotation provided to the User prior to the provision of such services. Certain Additional Services may be provided by third-party service providers (hereinafter “Third-Party Providers”). Payments for services rendered by Third-Party Providers shall be made directly by the User to the relevant Third-Party Provider in accordance with such provider’s terms and conditions.

The Core Services and Additional Services are hereinafter collectively referred to as the “Services”.

1.3 The User expressly acknowledges and agrees that Medical Navigator:

  1. is not a licensed healthcare facility and does not provide healthcare, medical, diagnostic, therapeutic or related services (hereinafter “Medical Services”);

  2. does not act as a legal representative or agent of any Clinic and has no authority to bind any Clinic to any agreement or obligation;

  3. does not guarantee, warrant, or make any representations regarding the quality, safety, or efficacy of any Medical Services provided by any Clinic;

  4. does not guarantee or warrant any specific outcome of Medical Services for the User;

  5. does not exercise any control over, and bears no responsibility for, the clinical decisions, treatment protocols or medical recommendations of any Clinic;

  6. assumes no liability for any payment disputes between the User and any Clinic regarding Medical Services.

The contract for provision of Medical Services is concluded directly between the User and the relevant Clinic. The Company is not a party to any such contract and assumes no liability arising therefrom.

Coordinators shall not provide medical advice, diagnoses or treatment recommendations. The Services are provided for informational and organizational purposes only and shall not be construed as medical advice or a substitute for professional medical consultation, diagnosis or treatment.

The User acknowledges that any decisions regarding medical treatment are made solely by the User and the relevant Clinic. The User assumes full responsibility for such decisions.

In the event of a medical emergency, the User shall immediately contact emergency services. 

1.4 Information regarding Clinics displayed on the Website is obtained from the Clinics themselves or from publicly available sources. The Company does not warrant the accuracy, completeness, reliability or timeliness of such information. The User acknowledges that information on the Website shall not replace the User’s own due diligence in selecting a Clinic.

2 User Eligibility and Obligations 

2.1 The User represents and warrants that: 

  1. they possess full legal capacity under the laws of their jurisdiction of residence;

  2. they are at least eighteen (18) years of age;

  3. their use of the Website and Services does not violate any applicable law or regulation.

2.2 The User may utilize the Services on behalf of a third party, including a minor, provided that the User has the legal authority to act on such third party’s behalf and agrees to assume full responsibility for compliance with these Terms and for any acts or omissions of such third party.

2.3 The User shall: 

  1. provide accurate personal and contact information;

  2. provide complete, accurate, and truthful information regarding their medical condition, medical history, and current health status;

  3. promptly notify the Company and relevant Clinic of any material changes to their health status or upon becoming aware that any information previously provided was inaccurate or incomplete.

2.4 The Company is entitled to rely on all information provided by the User without independent verification. The User acknowledges that inaccurate, incomplete, or misleading information may result in inappropriate recommendations or unsuitable Clinic selection, and the Company shall bear no liability for any consequences arising therefrom.

3 Payment, Cancellation and Withdrawal

3.1 Core Services are provided to the User at no charge. The Company reserves the right to introduce fees for any Services upon reasonable prior notice to Users. Fees for Additional Services shall be as set forth on the Website or in an individual quotation provided to the User. A contract for Additional Services is concluded upon the User’s placement of an order, whether through the Website or by accepting a quotation. All payments for Medical Services are a matter exclusively between the User and the relevant Clinic, and the Company assumes no liability for any payment disputes arising therefrom.

3.2 The User may discontinue use of the Core Services at any time without cause. With respect to Additional Services:

  1. in the event of cancellation prior to the provision of such Services, the User shall be entitled to a full refund of any amounts paid, less any costs already incurred by the Company;

  2. in the event of cancellation after the Services have been partially or fully provided, no refund shall be issued for Services already rendered.

Cancellation and refund policies with respect to Medical Services are determined exclusively by the relevant Clinic, and the Company bears no responsibility therefore.

3.3 If the User is a consumer within the European Union, the User has the right to withdraw from any contract for paid Additional Services within fourteen (14) days without giving any reason. The withdrawal period shall expire fourteen (14) days from the day of conclusion of the contract. The right of withdrawal shall not apply to: 

  1. Services fully performed before the expiry of the withdrawal period, if performance began with the User’s prior express consent and acknowledgement that the right of withdrawal would be lost upon full performance;

  2. accommodation, transport, or other services where the contract specifies a particular date or period of performance.

3.4 To exercise the right of withdrawal, the User must inform the Company of their decision by an unequivocal statement sent to: K.B. Innovation Group, Staré Grunty 204/16, 841 04 Bratislava, Slovakia, Email: info@medicalnavigator.com. The User may use the model withdrawal form below, but it is not obligatory. If the User withdraws from the contract, the Company shall reimburse all payments received from the User without undue delay and in any event not later than fourteen (14) days from the day on which the Company is informed of the User’s decision to withdraw, using the same means of payment as the User used for the initial transaction. If the User requests that performance of Additional Services begin during the withdrawal period and subsequently withdraws, the User shall pay the Company an amount proportionate to the Services provided up to the point of withdrawal.

4 Limitation of Liability

4.1 The Company provides organizational and informational services only and does not provide Medical Services. Accordingly, the Company’s liability is limited to the Services it directly provides. With respect to Additional Services, the Company shall be liable only for organizational errors directly attributable to the Company. The Company shall not be liable for the performance or non-performance of any Third-Party Provider, save for errors in selection or instruction of such providers attributable to the Company.

4.2 The Company shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, war, government actions, or disruptions to transportation.

4.3 The Company shall be liable without limitation for damages caused by willful misconduct or gross negligence, and for damages arising from injury to life, body, or health. Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable law.

5 Governing Law and Dispute Resolution 

5.1 These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic. Any disputes arising out of or relating to these Terms shall be submitted to the jurisdiction of the courts of the Slovak Republic. If the User is a consumer, mandatory consumer protection laws of the User’s country of habitual residence shall apply to the extent they provide greater protection, and the User may bring proceedings in the courts of such country. 

5.2 Prior to initiating any legal proceedings, the User is encouraged to contact the Company at info@medicalnavigator.com to seek an amicable resolution of any dispute or complaint.

6 Final Provisions 

6.1 The Company reserves the right to amend these Terms at any time. Continued use of the Services following any amendments constitutes acceptance of such amendments. 

6.2 The Company’s collection and processing of personal data is governed by the Privacy Policy available at www.medicalnavigator.com/privacy-policy. By using the Services the User acknowledges having read and understood the Privacy Policy. 

6.3 The Website may contain links to external websites operated by third parties. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. The inclusion of any link does not imply endorsement of or affiliation with the linked website or its operator.

6.4 The Company reserves the right to refuse, suspend, or terminate the provision of Services to any User who: 

  1. breaches these Terms;

  2. provides false or misleading information;

  3. engages in abusive, threatening, or unlawful conduct towards the Company, its Coordinators, or any Clinic;

  4. uses the Services for any purpose other than seeking legitimate medical care.

6.5 If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the intended purpose.

6.6 These Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Company regarding the use of the Services and supersede all prior agreements, representations, and understandings. 

6.7 These Terms are drafted in English. In the event of any discrepancy between the English version and any translation, the English version shall prevail.
